Is Professional Responsibility easy?

Generally rated the most accessible of the five mandatory NCA subjects. However, the specific Federation Model Code provisions differ from Bar Council of India rules, SRA Code, NBA ethics rules, and other foreign codes. Candidates who learn the specific Model Code rules pass more consistently.

What is the Federation Model Code?

The Federation of Law Societies of Canada Model Code of Professional Conduct governs lawyer conduct across Canada — competence, confidentiality, conflicts of interest, duties to clients and courts, and withdrawal. All NCA Professional Responsibility questions are based on the Model Code.

How does Canadian confidentiality differ from other jurisdictions?

Canadian confidentiality under the Model Code covers all information relating to the representation of a client regardless of how obtained. Exceptions are narrow (serious imminent harm, defending own conduct, compelled by law). This is broader than solicitor-client privilege, which is an evidentiary rule.
