NCA Language Requirement 2026: What Lawyers Need to Know

Do you need to prove English proficiency for NCA exams? Complete guide to the language requirement, who is exempt, and which tests are accepted.

The short answer: The NCA requires English or French language proficiency proof from most internationally trained lawyers. Candidates who completed their legal education in an English-medium institution are typically exempt. This requirement was introduced in 2023 and significantly affects candidates from non-English-medium institutions.

What is the NCA language requirement?

Since 2023, the NCA requires candidates to demonstrate proficiency in English or French before their application can be processed. This is separate from the challenge exam registration process — it applies at the assessment stage.

The requirement exists because NCA challenge exams are conducted in English (or French in Quebec), and the NCA needs to be satisfied that candidates can meaningfully engage with the exam content.

Who is exempt from the language requirement?

You are likely exempt if: your law degree was taught and examined entirely in English; you completed a university degree in an English-speaking country (Canada, UK, USA, Australia, New Zealand, Ireland); or your native language is English and you have practised law in English.

Which language tests are accepted?

The NCA accepts several internationally recognised English proficiency tests. The most commonly used are IELTS (International English Language Testing System) and CELPIP (Canadian English Language Proficiency Index Program). The NCA sets minimum score requirements for each test — check nca.legal for current required scores.

French proficiency tests are accepted for candidates who intend to practise in Quebec.

How many attempts are you allowed?

There is no limit on how many times you can take a language proficiency test. However, each attempt costs money and tests have validity periods (typically 2 years). Plan your preparation to pass in as few attempts as possible.

What if you fail the language test?

If you do not meet the required scores, you will need to resit the test. Your NCA application cannot proceed until the language requirement is satisfied. Focus on the sections where you scored lowest and use official test preparation materials.

Does the language requirement cost extra?

Yes. Language tests cost money (IELTS typically CAD $300+) and this cost is separate from the NCA assessment fee ($400 CAD + taxes). Budget accordingly if you need to take a language test.

The 2029 enhanced requirement

The NCA has announced that from 2029, all exams will move to in-person format and language requirements may be enhanced. If you are planning your NCA timeline, completing your exams before 2029 avoids any additional requirements that may come into force.

Bottom line

Check your exemption status before applying. If you are not exempt, take the language test early so it does not delay your assessment. Most UK, Indian, Nigerian, and Philippine lawyers who studied at English-medium institutions will be exempt — but always verify.
